An extract from the USRR (Unified State Register of Rights to Real Estate and Transactions with It) is the only legal way to check the legal purity of real estate during a transaction. If you buy an apartment, ask the seller for an extract from the USRR for it, and be sure to check that this extract was given recently. The more recent the statement, the less likely it is that the information in it is outdated.
It is necessary
- - passport,
- - money to pay for the service,
- - application for the issuance of an extract.
Instructions
Step 1
To get an extract from the Unified State Register, contact the authority where the rights to this property were registered - Rosreestr or Regpalat. In accordance with paragraph 4 of Art. 131 of the Civil Code of the Russian Federation, an extract from the USRR must be provided to any body that registers real estate, regardless of the place where the registration was made. In fact, everything is a little different - until now, you can get an extract from the register only in the body where the registration of these rights was carried out. The reason for this is simple - the USRR is generally kept on paper, so it is available only where the registration was made. The planned computerization of the Unified State Register of Legal Entities will greatly facilitate the life of the applicants.
Step 2
Another option for obtaining an extract from the USRR is to contact a real estate agency, a realtor, or a private law office. You do not have to deal with this issue yourself, but you have to spend a certain amount as a service fee - and an extract will cost you more.
Step 3
If you decide to receive an extract yourself, you must pay for the services for issuing it. The average price is from 100 to 300 rubles in various organs. To obtain an extract regarding an enterprise as a property complex, the service will cost a little more, 500 - 600 rubles. The cost of an extract from the USRR must be clarified at your Rosreestr branch. After payment of the receipt, you must fill out an application for the provision of an extract.
Step 4
Take your receipt, passport and completed application and contact Rosreestr with these documents. Within 5 days, the territorial division of Rosreestr must provide you with the requested information or give you a reasoned refusal in writing. You can appeal the refusal in court. If the USRR is maintained on electronic media, then the extract must be provided no later than one business day following the day of your application.
