Step 1

Any traffic accident must be recorded by the traffic police with drawing up a protocol at the scene of the incident, on the basis of which you will receive compensation for material damage under the MTPL. But, unfortunately, the amounts paid cannot always cover all the material costs associated with car repairs, especially if your vehicle has suffered enough damage.

Step 2

Damage related to repairs can be compensated on a voluntary basis. If the perpetrator of the accident does not plan to do this, you will have to file a statement of claim with the arbitration court. Attach a full package of documents confirming your expenses to the application.

Step 3

You will need to present: - an independent examination certificate with the estimated cost of the repair; - the certificate of inspection of the car by the specialists of the car service you applied to for the repair; - the calculation of the cost of the repair; - payment documents confirming your expenses for the repair.

Step 4

The court will consider your documents, interview witnesses, victims, on the basis of which it will issue an order with the specified amount for compensation for damage related to the repair of the vehicle and other expenses, for compensation of which you have filed a claim against the defendant.

Step 5

Compulsory reimbursement of expenses is made on the basis of a writ of execution. You can show it at the place of work of the perpetrator of the accident, in a bank where there are savings accounts, or contact the bailiff service. Based on your application, enforcement proceedings will begin to reimburse the costs of car repairs.

Step 6

The funds will be credited to your account in installments. The law does not prohibit the reimbursement of the entire amount of damage in a single amount, and if the culprit of the accident does not work, does not have accounts, his personal property will be described for further sale in repayment of obligations under the writ of execution.
