If you find a faded cloth instead of a new swimsuit after the first wash, do not despair. According to the law of the Russian Federation "On Protection of Consumer Rights", you can return it to the store and return the money for it, or replace it with another swimsuit of proper quality.
Instructions
Step 1
If the warranty period of the product has not yet come to an end, make a claim-statement in two copies, in which you ask for a refund for a defective product, describing the situation with its damage. Take them along with the product to the store and give one of them to the administrator. Leave the second copy with the administrator's note of receipt. If the store refuses to accept your claim, please send it by registered mail with notification.
Step 2
After that, the store has the right to send the item for examination, proving a manufacturing defect or the buyer's fault. In the first case, the store will be obliged to return the money to the buyer for the product, or replace it with another swimsuit of equal value. This examination is carried out for the buyer free of charge.
Step 3
According to the law, the store is obliged to return money for defective goods within 10 days. If he does not do this within the prescribed period, the buyer has the right to receive a penalty in the amount of 1% of the price of the goods. In the event that the examination recognized a defect in the product, and the store refuses to return the money, go to court.
Step 4
You can also return a swimsuit to the store in the first two weeks from the date of purchase, if it does not fit in style, size, shape or color. At the same time, the product must retain its presentation (labels, packaging, etc.), and you still have a receipt for its purchase in your hands.
Step 5
Many shops do not want to take back swimwear, citing the fact that this product belongs to lingerie. The latter, according to Art. 25 of the Law of the Russian Federation "On Protection of Consumer Rights" is included in the list of non-food products of good quality that cannot be exchanged or returned. Thus, they mislead the buyer and violate the law, since the swimsuit belongs to sports jerseys and, of course, is subject to exchange.
