Despite the fact that a gold piece can sometimes cost a fabulous sum, it is not always possible to return it to the store. The area of jewelry sales is regulated by law, and the return itself depends on the specific situation.
Instructions
Step 1
According to the Decree of the Government of the Russian Federation of 20.10.1998 No. 1222, products made of precious metals are included in the list of goods of good quality that cannot be exchanged for another product or returned. Therefore, you have no right to return gold to a jewelry store only on the basis that it did not suit you in shape, size or color.
Step 2
But if a defect was found on the product (holes, poorly fixed parts, etc.), or its quality does not correspond to the information specified in the documents for this product, you can safely demand a refund or replace it with another product. Since in this case there is a violation of the Law of the Russian Federation "On Protection of Consumer Rights".
Step 3
First, try to settle the matter amicably. Bring the defective item to the store and ask for a refund, referring to the above law, according to which the store is obliged to pay the required amount or exchange the item for another within 10 days from the date of contact. For violation of this period, an additional amount is charged in the amount of 1% of the price of the purchased goods.
Step 4
If the seller refuses to do this, preventing the possibility of a defect, you can order a paid examination, which will confirm or, conversely, reject the presence of a manufacturing defect in the product. In case of proof of marriage, the store that sold you a low-quality product is obliged to pay for the examination.
Step 5
Write in two copies a statement for the return or replacement of jewelry, and then give one of them to the store director. Leave the second one with the director's signature. Attach copies of the examination results to the application. If the director refuses to accept your application, send it by registered mail with courier delivery.
Step 6
Not having achieved a refund, you can safely go to court. In this case, the law will be on your side.
