A citizen who takes part in the case and who is not satisfied with the actions or inaction of the investigator has every right to write a complaint against this investigator. A complaint is a request from a citizen to protect or restore his violated rights, freedoms or interests.
Instructions
Step 1
A complaint is most often written when the investigator commits illegal actions against a person participating in the case, or drags out the investigation for no apparent reason. First of all, a complaint can be submitted to the head of the investigative body, in which the investigator works, and to the central office of the Investigative Committee, on whose website there is an Internet reception.
Step 2
It is also possible to file a complaint with the district court, which is responsible for the preliminary investigation. If there are several such district courts, then the complaint is submitted in accordance with the Resolution of the Supreme Court to the judicial authority at the location of the investigator. Also, a citizen has the right to complain to the district prosecutor's office. If her decision does not suit him, to the higher prosecutor's office of the constituent entity of the Russian Federation.
Step 3
The complaint can be submitted in person or sent by mail. When submitting a complaint in person or to the office, demand that you give you a copy (or a second copy, if you have prepared it) of the accepted complaint with a signature, a transcript of the person who accepted the complaint, date and stamp.
Step 4
According to the law, the consideration of the complaint takes place in an open court session. At this meeting, the presence of all interested persons is mandatory, that is, in addition to you (or a representative), the investigator, against whose actions the complaint was filed, must be present at the meeting. In the course of consideration, the court has the right to both recognize the appealed actions as unlawful, and to refuse the applicant to satisfy the complaint.
